These Terms & Conditions (“Terms”) govern your access to and use of the website operated by Mergun Agency Inc. (“Mergun Agency,” “we,” “our,” or “us”), including any education consulting, university application, transfer-support, and related services offered through our website or other authorized communication channels.

By accessing our website, selecting or purchasing a service package, submitting an intake form, providing documents, or using our services, you acknowledge that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you do not agree with these Terms, you must not purchase or use our services.

You must be at least 18 years old and legally capable of entering into a binding agreement to purchase our services.

If services are purchased for a person under 18, the purchase and all related authorizations must be completed by that person’s parent or legal guardian.

You confirm that all information you provide is accurate and that you have the legal authority to provide any personal, academic, immigration, or financial documents submitted to us.

Mergun Agency provides independent education consulting services to students seeking university transfer opportunities, admissions assistance, academic planning, and related educational support.

Depending on the package purchased, services may include:

• University matching and comparison
• University transfer guidance
• Admissions consulting
• Application preparation and submission
• Academic and immigration-document review
• Statement of Purpose guidance
• Resume or CV review
• Scholarship opportunity guidance
• Interview preparation
• Enrollment and SEVIS transfer guidance
• Financial-document and I-20 checklist guidance
• One-on-one education consulting
• Admissions coaching for competitive institutions
• Communication and follow-up with educational institutions

The exact services included in your purchase are determined by the package description displayed on our website and confirmed on the Review Order or checkout page at the time of purchase.

Mergun Agency is an independent education consulting company.

Mergun Agency is not:

• A university or degree-granting institution
• An immigration law firm
• A government agency
• An authorized representative of the U.S. government
• An organization permitted to make admission, visa, SEVIS, I-20, CPT, OPT, or immigration decisions

References to universities, partner institutions, programs, tuition assistance, or application opportunities do not mean that Mergun Agency owns, operates, controls, or has authority to bind an educational institution unless such authority is expressly confirmed in writing.

All university names, trademarks, logos, and program information belong to their respective owners.

Mergun Agency may offer general education consulting packages, including:

• University Match
• Transfer Strategy
• VIP Concierge
• Elite University Success

Features, prices, application limits, delivery timelines, and eligibility requirements vary by package. The package description and total price shown to you before payment form part of your service agreement.

Purchasing a general consulting package does not guarantee that a particular university, scholarship, academic program, immigration benefit, or admission outcome will be available.

Mergun Agency currently offers the following Clarewood University application-support packages:

This package may include:

• Initial eligibility review
• MBA or MPA application preparation
• Academic and immigration-document review
• Initial $75 university application/registration fee
• Application submission
• Admissions follow-up
• Enrollment and SEVIS transfer guidance
• Tuition-assistance confirmation processing
• Support through the admission decision

This package includes the services in the Complete Application Package, plus:

• Priority document review
• Application submission within one business day after all required information and documents are received and confirmed complete
• Dedicated application advisor
• One-on-one application review session
• Priority document corrections
• Expedited admissions follow-up
• Priority financial-document and I-20 checklist review
• Priority support through the admission decision

These are Mergun Agency application-support packages and are not tuition payments.

Unless expressly stated otherwise in writing, tuition and ongoing university charges are paid separately to the university.

The Clarewood application packages include the initial $75 university application/registration fee.

They do not include:

• Tuition
• The $60 quarterly registration fee
• Computer or technology fees
• Textbooks or supplies
• Health insurance
• Housing
• Transportation
• Food or personal expenses
• Credential evaluations
• Translation or notarization
• Government filing fees
• Visa or SEVIS fees
• Any other fee not expressly identified as included

University tuition, fees, policies, and billing amounts may be changed by the university. Final charges are determined by the university’s official billing statement.

Mergun Agency is not responsible for increases or changes in tuition, university fees, government fees, or third-party expenses.

All prices are stated in U.S. Dollars unless otherwise indicated.

Full payment must be received before services begin unless a different arrangement is confirmed by Mergun Agency in writing.

Payments may be processed through Stripe or another authorized third-party payment provider. Mergun Agency does not directly store complete payment-card information.

You represent that:

• You are authorized to use the selected payment method
• The billing information you provide is accurate
• You authorize the total amount displayed at checkout
• You have reviewed your selected package before completing payment

A payment confirmation does not constitute admission to a university or approval for tuition assistance, an I-20, a SEVIS transfer, CPT, a visa, or any other immigration or academic benefit.

For purposes of these Terms, services are considered to have begun when Mergun Agency first performs personalized work for you, including any of the following:

• Reviewing an intake form
• Reviewing academic, immigration, or financial documents
• Conducting an eligibility assessment
• Performing university research or matching
• Providing a consultation or individualized recommendation
• Preparing, correcting, or reviewing application materials
• Communicating with a university regarding your case
• Paying a non-refundable third-party fee on your behalf
• Beginning or submitting a university application

Submitting an intake form or documents after payment authorizes Mergun Agency to begin providing the purchased services.

Because our services involve personalized professional time, research, document review, application preparation, and third-party fees, refunds are limited.

You may submit a written cancellation request before personalized work begins.

If approved, the payment will be refunded, except for any non-refundable third-party fee already paid on your behalf and clearly disclosed to you.

Service fees become non-refundable once personalized work or application processing has begun.

No refund will ordinarily be provided because:

• You change your mind or decide not to continue
• You select a different school or service provider
• You fail to provide documents or respond on time
• You withdraw after application preparation begins
• A university denies, delays, or closes your application
• A university does not accept your transfer credits
• A scholarship or tuition benefit is not awarded
• Your SEVIS transfer, I-20, CPT, visa, or immigration request is delayed or denied
• A government or university changes its policies
• You provide incomplete, inaccurate, altered, fraudulent, or misleading information
• You fail to satisfy university, academic, financial, enrollment, or immigration requirements

For a package specifically offering university matching, Mergun Agency will provide a full refund if, after reviewing your academic profile and current educational circumstances, we determine that we cannot reasonably recommend an available institution offering a meaningful academic, financial, or personal advantage over your current institution.

A refund is not available merely because you decide not to apply to or attend a university that reasonably satisfies the criteria you provided.

Application, registration, evaluation, translation, government, and other third-party fees are non-refundable once paid to the applicable third party unless that third party returns the funds to Mergun Agency.

Refund requests must be submitted in writing to mergun.agency@gmail.com within seven business days after the event giving rise to the request.

Approved refunds will generally be issued to the original payment method. Processing times may vary depending on the payment provider and financial institution.

Nothing in this Refund Policy limits any non-waivable consumer right available under applicable law.

If you believe a payment was incorrect or a purchased service was not provided as described, you should contact Mergun Agency first so we can review and attempt to resolve the issue.

Initiating a payment dispute or chargeback does not automatically cancel these Terms or establish that a refund is owed.

Mergun Agency may suspend services while a payment dispute is pending. We may provide the payment processor or financial institution with relevant records, including:

• The package selected
• Acceptance of these Terms
• Payment confirmation
• Intake-form submissions
• Communications
• Documents received
• Work completed
• Application or submission records

Nothing in this section limits your lawful right to dispute a transaction with your financial institution.

You agree to:

• Provide complete, accurate, current, and truthful information
• Submit requested documents in a timely manner
• Review application information before submission when requested
• Respond promptly to communications and document-correction requests
• Notify us of changes affecting your academic, financial, or immigration situation
• Meet university and government deadlines
• Maintain lawful immigration status when applicable
• Obtain qualified legal advice when immigration or other legal advice is required
• Pay tuition and all university or third-party charges not included in your package
• Comply with university, SEVIS, visa, academic, enrollment, and employment requirements

You remain responsible for the accuracy and authenticity of every document and statement submitted in connection with your application.

Mergun Agency may refuse to use or submit any document that appears altered, misleading, fraudulent, incomplete, or inconsistent.

By purchasing application services and submitting your information, you authorize Mergun Agency to:

• Review and organize your application materials
• Prepare application forms using information you provide
• Communicate with educational institutions about your application
• Submit documents and application materials with your authorization
• Receive application-related updates
• Share relevant information and documents with the institution to which you are applying
• Assist with admission, enrollment, tuition-assistance, and document-checklist processes

You may be required to personally review, certify, or sign certain university or government forms.

Mergun Agency will not knowingly submit false or fraudulent information and may suspend or terminate services if the authenticity or accuracy of submitted information cannot be reasonably verified.

Our collection, use, and disclosure of personal information are further described in our Privacy Policy.

Admission decisions are made solely by the applicable educational institution.

Mergun Agency does not guarantee:

• Admission to any university
• Admission by a particular date
• University transfer approval
• Acceptance of transfer credits
• Eligibility for a specific program
• Scholarship or tuition-assistance awards
• Issuance of an acceptance letter
• Issuance of an I-20
• SEVIS transfer or registration
• Visa approval
• CPT or OPT authorization
• Employment or internship opportunities
• Graduation within a specific period
• Any specific academic, professional, financial, or immigration outcome

If a limited admission assurance is available for a particular partner institution, it applies only after Mergun Agency reviews the student’s profile, confirms that all stated requirements are satisfied, and provides the assurance separately in writing.

The university retains final authority over every admission decision.

Mergun Agency is not a law firm and does not provide legal advice, legal representation, or immigration representation.

Information about F-1 status, visas, SEVIS, I-20 documents, school transfers, CPT, OPT, annual vacation, employment, or immigration regulations is provided only for general educational and application-support purposes.

SEVIS transfers, I-20 issuance, CPT authorization, annual vacation eligibility, and other F-1 matters are determined by the applicable school’s Designated School Official and relevant government authorities.

CPT is not automatic or guaranteed. A student must satisfy all university and federal requirements and receive written CPT authorization from the school’s Designated School Official before beginning employment.

You should consult a qualified immigration attorney regarding legal questions or circumstances that may affect your immigration status.

Eligible students who apply to Clarewood University through Mergun Agency may receive 50% tuition assistance for the standard duration of an eligible MBA or MPA program.

This particular tuition-assistance opportunity is available only to eligible students whose application is submitted and processed through Mergun Agency.

To qualify, a student must:

• Apply through Mergun Agency
• Meet Clarewood University’s admission requirements
• Receive final admission approval
• Enroll in an eligible intake and program
• Complete all required enrollment steps
• Maintain applicable academic, enrollment, and eligibility requirements
• Satisfy any additional written conditions issued by the university

The assistance applies to tuition only. It does not apply to registration, computer, technology, textbook, insurance, housing, transportation, or other charges unless expressly confirmed in writing.

Students applying directly to Clarewood University or through another organization may not qualify for this Mergun Agency tuition-assistance opportunity.

Mergun Agency assists with the tuition-assistance confirmation process, but final confirmation and continued eligibility are subject to the university’s written approval and requirements.

Information concerning:

• Quarter schedules
• Number of courses per quarter
• In-person class frequency
• Annual vacation eligibility
• Program length
• Course availability
• Academic delivery format
• Intake dates
• Campus requirements

is based on information available when published and may be revised by the university.

An annual vacation quarter is not automatically guaranteed. Eligibility depends on the student’s academic and F-1 history and approval by the school’s Designated School Official.

Final schedules, attendance requirements, course formats, and enrollment requirements are determined by the university.

For the Clarewood VIP Fast-Track Application, Mergun Agency will aim to submit the application within one business day after:

• Full package payment has been confirmed
• The intake form has been completed
• All required information and documents have been received
• Any necessary corrections have been completed
• Mergun Agency confirms that the application is complete and ready for submission

The one-business-day period begins only after Mergun Agency provides or records confirmation that the required materials are complete.

This timeline applies only to Mergun Agency’s application-submission process. It does not apply to:

• University review or processing
• Admission decisions
• Acceptance-letter issuance
• I-20 processing
• SEVIS transfers
• Tuition-assistance confirmation by the university
• Visa processing
• Third-party or government decisions

Delays caused by incomplete documents, inaccurate information, client response time, university systems, technical problems, holidays, emergencies, or circumstances outside Mergun Agency’s reasonable control do not constitute a breach of the VIP submission timeline.

An eligible Mergun Agency client may receive one $100 referral cashback reward by referring one new student who applies to Clarewood University through Mergun Agency.

To qualify:

• The referring student must have purchased an eligible Clarewood application package
• The referred student must be a new applicant who has not already purchased a package or begun processing with Mergun Agency
• The referred student must identify the referring student before or at the time of purchase
• The referred student must purchase an eligible package in full
• The payment must be successfully completed
• The referred student must submit the required intake information
• Application processing for the referred student must begin
• The referred payment must not be refunded, reversed, disputed, or charged back

The reward is:

• Limited to one $100 reward per referring student
• Not available for self-referrals
• Not available for duplicate applications
• Not transferable to another person
• Limited to the amount originally paid by the referring student
• Issued to the original payment method when reasonably possible

Eligible cashback will generally be processed within ten business days after all referral requirements are verified. Financial-institution processing times may vary.

If the referred payment is later refunded, reversed, disputed, or charged back before the cashback is processed, the reward will be canceled.

Mergun Agency may modify or discontinue the referral program for future referrals. Any referral already earned under the published requirements will be honored.

Our services may involve universities, payment processors, form providers, email providers, hosting providers, customer-management systems, document-processing providers, government agencies, or other third parties.

Mergun Agency does not control and is not responsible for:

• University admission decisions
• University processing times
• University or program closures
• Tuition or fee changes
• Scholarship decisions
• Transfer-credit evaluations
• Government or immigration decisions
• Visa-processing times
• Third-party website availability
• Actions, omissions, or services of independent third parties

Your use of a third-party platform or service may also be governed by that provider’s terms and privacy policy.

By using our services, you authorize Mergun Agency to communicate with you through the contact methods you provide, including:

• Email
• Phone
• SMS or text message
• WhatsApp
• Facebook Messenger
• Instagram Direct Message
• Website forms
• Other communication methods you request or approve

Service-related communications may include payment confirmations, intake forms, document requests, application updates, reminders, and admissions-related information.

Consent to receive promotional marketing messages is separate from service-related communication and may be withdrawn at any time.

You are responsible for maintaining accurate contact information and reviewing communications sent to you.

You consent to conducting transactions with Mergun Agency electronically.

By checking an acceptance box, selecting an acknowledgment, clicking a button stating that you agree or wish to continue, submitting an order, or otherwise electronically accepting these Terms, you intend to provide your electronic agreement to be bound by them.

You may retain a copy of these Terms by printing or saving this page. You may request a copy by contacting us.

Our collection, use, retention, sharing, and protection of personal information are governed by our Privacy Policy.

By using our application services, you acknowledge that relevant information and documents may be shared with:

• The educational institution to which you are applying
• Authorized service providers assisting with forms, payments, hosting, communications, or document processing
• Government authorities when required by law or necessary for an authorized application process

We do not sell or rent personal information as described in our Privacy Policy.

Except for third-party materials, all website content created and owned by Mergun Agency—including text, graphics, branding, designs, educational materials, package descriptions, and original content—is protected by applicable intellectual-property laws.

You may use our materials only for your personal, non-commercial use in connection with the services purchased.

You may not copy, reproduce, modify, distribute, publish, sell, commercially exploit, or falsely represent our content as your own without prior written permission.

University names, logos, trademarks, and third-party materials remain the property of their respective owners.

You may not use our website or services to:

• Submit false, altered, fraudulent, or misleading information
• Impersonate another person
• Infringe another person’s privacy or intellectual-property rights
• Attempt unauthorized access to our systems
• Interfere with website security or operation
• Copy or commercially exploit our materials without permission
• Engage in unlawful, abusive, deceptive, or harmful conduct
• Facilitate academic, financial, immigration, or identity fraud

Mergun Agency may suspend or terminate services if:

• Payment is reversed, disputed, or not completed
• The client fails to provide required information
• The client repeatedly fails to respond
• The client provides false, altered, fraudulent, or misleading information
• Continuing the service could violate university policy or applicable law
• The client engages in abusive, threatening, or unlawful conduct
• A conflict of interest or other serious professional concern arises

If services are terminated because of client misconduct or after personalized work has begun, fees already paid will remain non-refundable to the extent permitted by law.

To the fullest extent permitted by law, Mergun Agency and its officers, employees, contractors, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages arising from the use of our website or services.

Mergun Agency is not responsible for losses resulting from:

• University decisions
• Government actions
• Immigration-policy changes
• University-policy changes
• Missed opportunities caused by incomplete or late client responses
• Third-party delays or system failures
• Visa, SEVIS, I-20, CPT, OPT, employment, or admission outcomes
• Events beyond our reasonable control

To the fullest extent permitted by law, Mergun Agency’s total liability for a claim relating to a purchased service will not exceed the amount you paid to Mergun Agency for the specific service giving rise to that claim.

These limitations do not apply where liability cannot lawfully be limited, including liability arising from fraud, willful misconduct, or gross negligence.

To the extent permitted by law, you agree to indemnify and hold Mergun Agency harmless from third-party claims, losses, or expenses arising from:

• False, fraudulent, altered, or unauthorized documents you provide
• Materially inaccurate or misleading information you submit
• Your unlawful use of our website or services
• Your violation of these Terms
• Your infringement of another person’s rights

This section does not require you to indemnify Mergun Agency for its own fraud, gross negligence, or willful misconduct.

Mergun Agency will not be responsible for delay or failure caused by circumstances beyond our reasonable control, including:

• Government action
• Immigration or education-policy changes
• University closures or system failures
• Natural disasters or severe weather
• Public-health emergencies
• Labor disruptions
• Internet, hosting, or communication outages
• Payment-processor failures
• Cybersecurity incidents
• Other unforeseen emergencies

We will make reasonable efforts to resume affected services when practicable.

We may update service descriptions, prices, eligibility requirements, promotions, or these Terms from time to time.

Changes to package pricing will not alter the price of a completed purchase unless you later authorize an additional service.

Material revisions to these Terms will be posted with an updated “Last Updated” date. Revised Terms apply prospectively from the date they are posted unless otherwise stated or required by law.

Your continued use of our website or purchase of a new service after revised Terms are posted constitutes acceptance of the revised Terms.

These Terms are governed by the laws of the Commonwealth of Virginia, United States, without regard to conflict-of-law principles.

Before filing a legal claim, you and Mergun Agency agree to make a reasonable good-faith effort to resolve the dispute through written communication.

A written dispute notice should describe:

• The nature of the dispute
• The relevant service and payment
• The requested resolution
• Supporting information or documents

If the dispute cannot be resolved informally, it may be brought before a state or federal court located in the Commonwealth of Virginia that has proper jurisdiction.

Nothing in these Terms prevents either party from exercising a non-waivable legal right or contacting an appropriate consumer-protection or government authority.

If any provision of these Terms is found invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted, and the remaining provisions will remain in effect.

Failure by Mergun Agency to enforce any provision of these Terms does not waive our right to enforce that provision or any other provision later.

You may not transfer or assign your rights under these Terms without prior written permission from Mergun Agency.

Mergun Agency may assign its rights or obligations as part of a merger, restructuring, sale, or transfer of business operations, subject to applicable law.

These Terms, our Privacy Policy, the applicable package description, and the Review Order or checkout information presented at the time of purchase constitute the entire agreement between you and Mergun Agency concerning the purchased service.

If a separately signed written service agreement conflicts with these Terms, the separately signed agreement will control only with respect to the specific conflicting provision.
